The Kashmir issue was started in October 1947 when Jammu and Kashmir was declared as an independent state with an area of 85,806 square miles. As per the Census 1941 Majority of Muslim districts were declared as part of Pakistan and in the same way majority of Non-Muslim districts were so called India. There was a ruler of Jammu and Kashmir, Maharaja Hari Singh was decided to be as an independent state through the Standstill agreement which was accepted by Pakistan only. Summarily, Pakistan invaded Kashmir, India fought back after acceptance of Kashmir as an integral part of India. Now onwards, Jammu and Kashmir remained a disputed state.
After analysis of all the issues, it would be correct to say that Pakistan is definitely responsible for Kashmir Issue. I think at that time the Maharaja Hari Singh had no other option because Pakistan invaded precociously. Maharaja Hari Singh by recognizing the state of Jammu and Kashmir as an integral part of India, even after being declared independent state and then by faced an undeclared attack or war. Now, Pakistan funding and sponsored terrorism through Kashmir especially across the Valley forcing violence against the Kashmiri Hindus and Pandits.
Pakistan Claimed. Pakistan claimed that Kashmir was touching with their territory. It had a large muslim majority in most districts, according to the Census 1941 Kashmir should have belonged to Pakistan as it had a large muslim majority in most districts.
India’s Perspective. Kashmir was ruled by a ruler Maharaja Hari Singh who wished to join India after sudden aggression of tribal invaders from Pakistan. They were committing atrocities. He had signed on The Instrument of Accession that The Kashmir will be known as an integral part of India. However, Instrument accession stipulated that the state would surrender its powers of defence, external affairs, and communications to India. Presently The Union Budget for 2024-25, presented by Finance Minister Nirmala Sitharaman, has allocated Rs 42,277.74 crore to Jammu and Kashmir, marking a nominal increase of 1.2 per cent from the previous fiscal year’s allocation of Rs 41,751.44 crore.
1. Article 370. Article 370 was the basis of Jammu and Kashmir’s accession to the Indian union at the time when ruler Maharaja Hari Singh, had the choice to join either India or Pakistan after their independence from the British rule in 1947. The article came into effect in 1949. The main purpose of the Article 370 is the exemption of Jammu and Kashmir from the Indian constitution. It allows to make its own laws in all matters except finance, defence, foreign affairs & communication. Jammu & Kashmir can have a separate constitution and a separate flag and a person from outside of Kashmir cannot purchase property.
2. Article 35A. Article 35A was introduced through a presidential order in 1954 to continue the old provisions of the territory regulations under Article 370 of the Indian constitution. This Article prohibit outsiders settle in the Jammu & Kashmir, buying land, getting local government jobs.
Regarding this, there are having a different ideas or opinions of the people of the state of Jammu and Kashmir. Three types of people are usually found in the state of Jammu and Kashmir. This can be a proper analysis of what are the main issue which can be resolved or not: –

| July 2001 | Amarnath yatris were again targeted, this time at the Sheshnag base camp in Anantnag, killing 13. |
| October 1, 2001 | Jammu & Kashmir State Legislature Complex in Srinagar was struck by a suicide (fidayeen) terrorist attack, killing 36 people. |
| 2002 | Terror struck at Chandanwari base camp, and 11 Amarnath yatris were killed. |
| November 23, 2002 | Nineteen people, including nine security force personnel, three women and two children, lost their lives in an Improvised Explosive Device (IED) blast at Lower Munda in South Kashmir on the Jammu-Srinagar national highway. |
March 23, 2003 | Terrorists massacred at least 24 Kashmiri Pandits, including 11 women and two children, at Nandimarg village in Pulwama district. |
| June 13, 2005 | Thirteen civilians, including two school children, and three CRPF officers were killed, and over 100 people sustained injuries when an explosives-laden car blew up at a crowded marketplace in front of a government school in Pulwama. |
| June 12, 2006 | Nine Nepali and Bihari laborers were killed in Kulgam. |
| July 10, 2017 | 08 Amarnath Yatris killed (On bus attack). |
| Jun 09, 2024 | 09 Civilians killed (Opened fire on a bus) |
| April 22, 2025 | 26 People killed in Pahalgam (Targeted tourists) |
This is a question which usually comes under the mind of every Indian after any incidents occurred in Jammu & Kashmir. However, let me clear the thought that it will never be going to happen. Let’s see point by point, what will happen if Kashmir is given to Pakistan: –
Kashmiris fear the move would lead to a demographic transformation of the region from majority-Muslim to majority-Hindu. The government have not just struck down the provision of 370, but they have actually dismantled the fate of Jammu and Kashmir as it existed in the Indian constitution”. Presently Ladakh and Jammu and Kashmir declared as Union Territories which are centrally governed. However, when it comes to Terror against Tiranga, we can keep all concerns aside and focus only on how best the Tricolour’s prestige. That can be upheld, and common citizens live in Kashmir without fear.
Almost every state in India has its own identity Tamil Nadu, Karnataka, West Bengal, or Kerala. The people in each of these states even when seeing themselves as Tamilians, Kannadagans, Bengalis or Malayalis are also identified themselves as Indians. Only time can tell about the success of the changes made concerning the provisions of Article 370. Kashmir was and still is an integral part of India. It has a plural and secular culture – just like the rest of India. Urgent steps should be taken to bridge the gaps of trust deficit in the minds of Kashmiri youth.
